Terms and Conditions

1. ACCEPTANCE
These Terms and Conditions govern use of the Prime Diagnostics Patient Portal and mobile application, together referred to as the Service. By creating an account, submitting a practitioner-access request, signing in or using the Service, you confirm that you have read and accepted these Terms and the Privacy Policy.
Do not use the Service if you do not agree to these Terms.
2. PURPOSE OF THE SERVICE
The Service provides authorised patients and healthcare practitioners with access to radiology studies, medical images, reports and related information made available by Prime Diagnostics and connected authorised radiology systems.
The Service is an access and communication tool. The formal clinical record maintained by Prime Diagnostics or the relevant healthcare provider remains authoritative.
3. MEDICAL DISCLAIMER
The Service is not a medical device and does not diagnose, treat, cure or prevent any medical condition. It does not provide emergency care and does not replace consultation with a qualified healthcare professional.
Patients should discuss reports, symptoms, diagnoses and treatment decisions with their referring doctor or another appropriately qualified healthcare professional. In an emergency, contact the appropriate emergency service or attend an emergency medical facility.
4. ELIGIBILITY AND VERIFICATION
Patient accounts are intended for people whose identity can be verified and matched to authorised Prime Diagnostics records.
Practitioner access is limited to appropriately qualified and authorised healthcare professionals. Prime Diagnostics may verify identity, practice number, professional details and the legitimate need for access before approving, activating, suspending or withdrawing access.
A person acting for another individual may be required to provide proof of authority, guardianship, parental responsibility or professional entitlement.
5. ACCURATE INFORMATION AND CONSENT
Users must provide complete, accurate and current information. A user may not impersonate another person, register using information they are not entitled to use or attempt to obtain unauthorised access to records.
Prime Diagnostics may record the date and version of the Privacy Policy and Terms accepted by the user for compliance and audit purposes.
6. ACCOUNT SECURITY
Users are responsible for protecting usernames, passwords, verification codes, devices and active sessions. Credentials may not be shared.
Prime Diagnostics may revoke sessions, require re-verification, reset access, suspend an account or take other reasonable steps where access or security is at risk.
7. AUTHORISED USE
Users may not:
- access another person’s information without authority;
- bypass authentication, authorisation or security controls;
- share confidential patient information with an unauthorised person;
- scrape, crawl or bulk-download information without written approval;
- reverse engineer, probe, disrupt or overload the Service;
- introduce malicious code;
- misrepresent professional status; or
- use the Service for an unlawful purpose.
8. CONFIDENTIALITY
Patient information is confidential. Healthcare practitioners must use information obtained through the Service only for authorised clinical or professional purposes and must comply with applicable confidentiality, healthcare, professional and data-protection duties.
Patients are responsible for choosing when and with whom they share reports or images after accessing them.
9. SERVICE AVAILABILITY
Prime Diagnostics aims to provide a reliable Service but does not guarantee uninterrupted or error-free availability. Access may be affected by maintenance, connectivity, power failures, device limitations, security controls, third-party systems or circumstances outside reasonable control.
Where app information is incomplete, delayed or inconsistent, the authorised radiology system and formal clinical record remain the authoritative source.
10. SUSPENSION AND TERMINATION
Prime Diagnostics may suspend, restrict or terminate access where information cannot be verified, access is no longer authorised, a user breaches these Terms, security is threatened, professional status changes or action is reasonably necessary to protect users or connected systems.
A user may request account closure through an available in-app process, the public deletion-request process or by contacting Prime Diagnostics. Account closure does not require deletion of clinical records or other information that must lawfully be retained.
11. INTELLECTUAL PROPERTY
The Service software, branding, design, text and supporting materials are owned by or licensed to Prime Diagnostics. Users receive only a limited, revocable and non-transferable right to use the Service for its intended purpose.
Nothing in these Terms limits lawful patient rights of access to their own medical information.
12. THIRD-PARTY SERVICES
The Service depends on authorised hosting, email, operating-system, connectivity and radiology-system services. Prime Diagnostics is not responsible for failures caused solely by third-party services outside its reasonable control, but will take reasonable steps to protect information and restore access where practicable.
13. LIABILITY AND GOVERNING LAW
Nothing in these Terms excludes liability that cannot lawfully be excluded under South African law.
To the fullest extent permitted by law, Prime Diagnostics is not liable for loss caused by unauthorised credential sharing, use of an insecure device, reliance on the Service as a substitute for medical advice, failure to seek appropriate clinical care or circumstances outside Prime Diagnostics’ reasonable control.
These Terms are governed by the laws of the Republic of South Africa, subject to mandatory consumer, healthcare and data-protection rights.
14. PRIVACY, CHANGES AND CONTACT
The Privacy Policy available at https://results.primerad.co.za/privacy.php forms part of these Terms.
Prime Diagnostics may update these Terms when the Service, law or operational requirements change. The current version will remain available at https://results.primerad.co.za/terms.php and within the mobile application. Material changes may require renewed acceptance.
